If you create an account on our site, you are responsible for maintaining the confidentiality of your login information. You shall not disclose it to any third party. We reserve the right to disable any user account, whether chosen by you or allocated by us, at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these terms. Prices:

Prices for our products are subject to change without notice.

We reserve the right to modify or discontinue, temporarily or permanently, the Service  at any time with or without notice.

You agree that we shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.


We reserve the right at our sole discretion to limit or cancel quantities purchased per person, per household, or per order. We reserve the right to refuse an order placed by you with us prior to order acceptance. We reserve the right to limit or prohibit orders that are placed by dealers or distributors. In the event that we make change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.




Availability:

All orders for the Products are subject to the availability of those Products and the materials necessary for making the Products. We will notify you as soon as possible after receipt of your order if, for any reason, the Products which you have ordered are not available or are subject to any delay.

In case we cannot supply any Product to you, for example, due to the concerned gemstone being out of stock or due to an error in price, we will notify you with such information as soon as possible by email and will not process the order. If you have already paid the amount for the Product, then we almost immediately fully repay the amount.

Liability Limitation:

To the maximum extent allowed by applicable law, in no event shall Browch Elyas or anyone representing Browch Elyas be liable to you under contract, tort, strict liability, negligence or any other legal or equitable theory, with respect to: a) Any lost profits, data loss, cost of procurement of substitute goods or services, or direct, indirect, incidental, special punitive, compensatory or consequential damages of any kind whatsoever resulting from:


(i) Your access to, use of, or reliance on, any content available through the services or any errors or omissions in any content;


(ii) Any unauthorized access to or use of the services or Browch Elyas secure servers and/or any and all personal information and/or financial information stored therein;


(iii) Any interruption or cessation of transmission to or from the services;


  1. iv) Any bug, virus, Trojan horse, or the like that may be transmitted to or through our services by any third party, howsoever caused;

  1. v) Any products provided in connection with the service whether as part of the free home trial service or otherwise including allergic reactions and other skin conditions caused by or connected with the use of our products.

These limitations shall apply notwithstanding the failure of essential purpose of any limited remedy hereunder. Neither party shall be liable to the other for consequential, indirect or punitive damages arising out of or related to this Agreement, whether in tort, strict liability, breach of contract, breach of warranty or any other legal theory, and whether or not ToucheDoree was advised of the possibility of such damages.
